These Terms of Use set out the terms and conditions for use of this ADHD Behavioral Therapy by Applied Behavioral Health Practice ("Website") and any content, Public Forums, or services offered on or through the Website and/or through any mobile application(s) ("Application") (collectively referred to as the "Platform").
These Terms of Use apply to end users of the Website (referred to as "Learners", "You", "Your"). These Terms of Use, including the Privacy Policy and any other terms and conditions published on the Platform or communicated to you from time to time (collectively referred to as the "Agreement"), define the relationship and responsibilities between You and Creator (as defined herein) in using the Platform.
When we speak of "Creator", 'we', 'us', and 'our', we collectively mean ADHD Behavioral Therapy by Applied Behavioral Health Practice being the creator of this Platform and the content/materials/services contained therein.
Mandatory Acknowledgment: By accessing this Platform, You are agreeing to be bound by the terms of this Agreement. If You disagree with any part of this Agreement, please do not use the Platform.
If You're an individual You must be at least 18 (eighteen) years of age, or, if You are between the ages of 13 and 18, You must have Your parent or legal guardian's permission to use the Platform. If You are under the age of 13 years or 16 years (depending on your country of residence), You may neither use our Platform in any manner nor may You register for any content or services offered therein.
To access any Content offered on the Platform, we require You to register by providing Your name and email address. You may also be required to make payment of a fee to access the Content, if applicable.
Definition: "Content" shall mean any course or session (whether pre-recorded or live) published by the Creator on the Platform, including reference materials and text files offered as part of the Content.
When You register for any Content, You may also have access to discussion forums that enable You to exchange thoughts and knowledge ("Public Forum"). Participation is completely optional.
We reserve the right to refuse access to the Platform or remove content posted by You in the Public Forums at any time without notice if You have violated any provision of this Agreement.
You are granted a limited, non-exclusive license to access and view the Content on the Platform for Your own personal, non-commercial use only.
Prohibited Activity Matrix:
- Modify, edit or copy the Content or any material made available on the Platform
- Create derivative works or exploit any material in an unauthorized manner
- Publicly display the Content for commercial purposes
- Attempt to decompile or reverse engineer any software asset
- Remove copyright or proprietary notations from the documentation
- Transfer materials to another person or 'mirror' on any other server infrastructure
Definition: "Creator Content" includes any audio files, video files, images, text materials uploaded by the Creator on the Platform.
Notice of Revocation: This license shall automatically terminate if You violate any of these restrictions and may be terminated by us at any time.
The Platform includes Public Forums designed to enable You to communicate with us and other registrants. Use of these forums is completely optional.
If You choose to participate, You agree to adhere to the Code of Conduct specified below. We may terminate or suspend Your access to Public Forums at any time, without notice, for any reason.
You represent and warrant that You own all rights in content uploaded by You ("Learner Content"). You are solely responsible for the Learner Content including its legality, reliability, accuracy, and appropriateness.
License Grant: By posting content, You grant us a non-exclusive, royalty-free, irrevocable, perpetual right to use, reproduce, modify, adapt, publish, and display such Learner Content throughout the world in any media.
Legitimate Usage
Use the Platform only for lawful purposes. Do not engage in activities that violate any applicable local, state, or federal healthcare laws and clinical regulations.
No Harmful Content
Content that incites violence, causes structural harm, or compromises systemic safety profiles is expressly prohibited from our portals.
No Hate Speech
We do not tolerate hate speech, defamatory structural statements, or content that incites systematic hatred against specific groups or individuals.
No Graphic Violence
Content designed to shock, disturb, or promote illicit actions or clinical disruption is strictly banned.
No Harassment
Harassment, bullying, digital tracking, target intimidation, or leaking protected private verification information is prohibited.
No Spam
Untargeted, unwanted, repetitive entries or malicious hyperlinks are blocked automatically by verification filters.
No Scams
Deceptive practices, malicious extortion, social engineering schemes, or platform manipulation are strictly prohibited.
No Impersonation
Pretending to be another verified participant, external clinician, or legal organizational representative is not allowed.
Enforcement Mandate: Violation of these structural boundaries will result in immediate termination of Your platform tokens without refund options.
We own all information and materials provided on the Platform, including Content, Creator Content, trademarks, logos, design architecture, and software engines ("Creator's Intellectual Property").
Property Protocol: You do not acquire any ownership rights to Creator's Intellectual Property by using the Platform. The Creator's Intellectual Property is protected by applicable state and federal intellectual property laws; unauthorized parsing is prohibited.
If You submit suggestions, ideas, comments, or questions containing product feedback ("Feedback"), You grant us a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, and distribute such Feedback.
You shall have no intellectual property right in any Content or Platform as a result of our incorporation of Feedback loops into the clinical modules.
To register for Content, You may need to pay a fee ("Content Fee"). Payment processing is securely handled through external merchant pipelines.
Refund Notice: Once You purchase access to Content, it cannot be cancelled and there shall be no refund of the Content Fee, unless otherwise explicitly authorized within our formal Refund Policy documentation.
We do not capture or store your structural personal bank information. Please verify terms and conditions of third-party clearers during transactions.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" with all operational faults and software bugs without structural warranty parameters of any kind.
To the maximum extent permitted under applicable law, we expressly disclaim all warranties, whether express, implied, statutory or otherwise, including all implied warranties of merchantability, fitness for a particular clinical purpose, title, and non-infringement.
We make no representation or warranty that:
- The Platform architecture will meet Your exact requirements
- The Platform will remain completely uninterrupted or error-free
- Any clinical tracking metric or data point is perfectly accurate or reliable
- The structural engines or outgoing automated emails are free of server viruses
The Creator shall not be liable for any damages (including loss of data, tracking profit, or corporate business interruption) arising from the use or inability to use the Content or Platform materials, even if formally notified of the structural possibility of such damage profiles.
Some state jurisdictions do not allow statutory limitations on implied warranties or legal liability for consequential damages, so these strict limitations may not apply to Your account.
You shall indemnify and hold harmless the Creator and its officers, directors, clinical agents and employees from any claim, demand, or actions including reasonable attorney's fees, made by any third party due to or arising out of Your breach of this Agreement or structural violation of any law or rights of a third party.
We have not reviewed all sites linked to our Platform and are not responsible for their contents. The inclusion of any outbound link does not imply corporate endorsement. Use of any linked website portal is strictly at Your own operational risk.
Any claim relating to the Platform shall be governed strictly by the laws of the Creator's home jurisdiction without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the regional courts at Creator's home jurisdiction base.
The automated chat assistant on this site is designed to provide general information and structural background support related to ADHD and behavioral health modules. It is not a substitute for direct medical advice, clinical diagnosis, or medical treatment plans.
This automated tool does not generate personalized clinical recommendations and should not be relied upon for critical decisions about health, immediate safety, or crisis well-being. By interacting with this feature, you acknowledge that any automated structural information provided is for educational reference purposes only.
By accessing this Platform, you acknowledge that you have read, understood, and checked our formal Notice Regarding the No Surprises Act and Good Faith Estimates Framework.
Alteration of Platform or Amendments
We reserve the right to make operational changes to our Platform, internal practice policies, and this tracking Agreement at any time. Updates will be published with a modified timeline identifier. You should scan the portal regularly for structural modifications.
Waiver
If You breach these conditions and we execute no immediate operational response, we will still retain full entitlement to use our rights and structural remedies in any other situational context.
Assignment
You may not assign, allocate, or transfer this tracking Agreement parameter. Any attempt will be null, void, and scrubbed from platform servers.
Severability
If any provision is deemed unenforceable by court order, it will be limited to the minimum extent necessary so that the remaining core of this Agreement remains in effect.
Events Beyond Our Control
We will not be held responsible for operational delivery delays or infrastructure failures arising from structural forces beyond our reasonable control.
